first time home buyer – owner loan

Will my wife be eligible for the First-Time Home Buyer Credits?

di_cassano asked:

I bought a home 2 years ago, the home owner is myself only. If my wife buys a $200,000 worth of home in February, will she be able to claim the $8,000 tax credit as a first time home buyer? Thanks.

Margaret

    No.

In a married couple, both individuals must be able to qualify on their own or else neither of them qualify.

You do not qualify so she does not qualify.

No she can not, the law clearly states that a souse has to qualify as well.

You would both have to be first time home buyers to get the credit. The new extended tax credit does allow for a repeat buyers to get up to $6,500 but for this credit you would have to have owned a home for 5 of the last 8 years.
