Will my wife be eligible for the First-Time Home Buyer Credits?

I bought a home 2 years ago, the home owner is myself only. If my wife buys a $200,000 worth of home in February, will she be able to claim the $8,000 tax credit as a first time home buyer? Thanks.

Nope. Legally, you and your wife are the same person.

the $8000 credit was for primary homes purchased by Nov. 30, 2009, she missed it

Nope. For a married person to claim the credit, BOTH spouses must be eligible for the credit. You clearly are not and that renders her ineligible as well. It does not matter that she is buying the home on her own, or whether you file a joint return or separate returns. Sorry!

No. You’re considered together, and together you are not a first time homebuyer.

No. For a married person to be eligible, their spouse must be also.
